Here's the situation. My lease expires at the end of this month. Monday evening landlord calls and tells me new lease is ready for me whenever I can come pick it up. When I go to pick up new lease Wed, landlord tells me that his daughter is moving down from Maryland (or somewhere up there) and that he is giving her the house instead of renewing my lease, so I have to move out. I have found a place to move into, but we are logistically and financially unable to to do it, and the place needs a lot of work to be livable as the previous tenants TRASHED it on their way out. The Charger is in still in pieces. The truck has got to have the engine rebuilt (have the parts and started pulling the motor today). I have sold both of my trailers in the past year. So what I'm begging for is this: if anyone close enough is able and willing to help me move, once I get these other issues straightened out, in exchange for a hamburger or two and a free beer or three, I would be forever in your debt.

Doug, is it legal in your state to do this? Might want to check, but most states have a 30 day written notice law in place so this very thing doesn't happen. Might be time to call a real estate lawyer or state housing authority to find out what rights you have. I know you've found another place, but it would buy you the time you need. And if the lawyer so advises it might get you compensatory damages for the move.
Other than that, chief, if I weren't in NY I'd be there in heartbeat.
 
Wish I could help you, a little far for me. There must be some laws to protect you, ramenth is likely right about the agencies set up to protect tenants. Check into it!

Dude, he can't do that to you. If you had a week by week lease arrangement he has to give at least a weeks notice, if you are on a monthly lease plan he has to give at least 30 days notice. This is per section 27-40-770 of the SC Landlord and Tenant Act. You need to contact your local Magistrates Office immediately. I would remind the landlord that he is subject to the State Law and you are entitled to fair, written notice according to that law. Now all this is based on you being up to date on rent, not overdue or in any violation of the rental agreement.
 
it would be easier for me to get more time if he was evicting me for nonpayment of rent. In that case, he would have to send certified letter, then take signed rec't to sheriff to file eviction, then wait for sheriff to serve me, then wait for court date, then judge would typically give 10-21 days to vacate. Unfortunately I have only been late one time. In July I didn't get the rent paid until the 12th and sold my work trailer to pay it. In THIS case, he has the upper hand and he knows it.

So far no written notice yet. I intend NOT to pay rent on time next month. I'll spend that money getting the new place ready to move in. Force to LEGALLY evict me. Then by the time it gets to the magistrate, I'll be out anyway. I CAN play his game. Don't wanta. Don't like it. But I CAN.

SECTION 27-40-660. Tenant's remedies for landlord's unlawful ouster or exclusion.
If a landlord unlawfully removes or excludes the tenant from the premises, or wilfully diminishes services to tenant by interrupting or causing interruption of essential services, the tenant may recover possession or terminate the rental agreement and, in either case, recover an amount equal to three months' periodic rent or twice the actual damages sustained by him, whichever is greater, and reasonable attorney's fees. If the rental agreement is terminated the landlord shall return security recoverable under Section 27-40-410.

I have no intention of fighting to stay here any longer than it takes me to get out. I have found a new place, and at a deal I'd be STUPID to pass on. I just can't make the move b/c I don't even have enough money for gas to drive the 13 miles back and forth to get it done. The "new" place needs a LOT of work due to previous tenants' totally trashing the place, including stealing the fridge and stove when they left. New landlord, who has been a true friend of mine for about 5 1/2 yrs, offered this deal: if I will move in and fix the place (fix it up however I want it, he doesn't care what I do to it), it's mine RENT FREE thru Jan 2010. For the rest of 2010, rent will be $200/month. At end of 2010, if I still want to stay there, he will sell me the place, owner financed, with all money invested into repairs to that point to count as down payment. It would take and IDIOT to pass on that deal. I just don't have the $ to make the move. Hell right now I don't even have the gas money I need to get Benjamin to his doctor appointment in Charleston (about 70 miles away) Tues morning.
