A sad day for my Dart and major life events

First of all, I got married Saturday 10/24- it was a great day and truly one of the happiest days of life so far. My wife (weird to say) and I spent the next week in Yosemite and San Luis Obispo (two of our favorite places). It was great to get away.

Unfortunately, the day before the wedding, an older woman ran a red light and did some pretty serious damage to my '72 Dart. This was entirely her fault. She was stopped at a red, and inexplicably decided to go as my friend and I entered the intersection. No one was hurt, though I'm still not sure how. Hitting a minivan nearly head on while travelling 25mph in a barely complete Dart is not my recipe for a safe stop.

The Dart needs fenders, a hood, a lower valance, radiator, bumper, bumper brackets, possibly hood hinges, grille, hood latch panel, and the incidentals associated there. The core support is warped and probably needs some time on a frame machine or puller of some sort. The right inner fender has wrinkles that weren't there before either. The hood also bounced off the cowl, which now has some dings in it.

I have hundreds of hours into this car, even if it doesn't show. There are tons of custom parts I've made involved, and days of paint and unfinished body work. The grille alone is tough to replace. I've seen them go for as high as $800. '72 is an off year for fenders... The entire drivetrain is brand-spanking new. The under-hood area was done with really nice paint work by Meep-Meep and myself. Air conditioning finally works well, and thankfully seems intact.

I'm looking for advice in dealing with my insurance company. I have good insurance, but I'm worried they will look at the unfinished nature of this project and try to snub me. The car is repairable, but they may deem it totaled due to the rest of its condition. The adjuster will be coming out some time this week, so I'm going to get receipts ready.

Any advice on insurance or the damage is appreciated. This also makes me appreciate shoulder belts, which my Charger does not have.

Congrats on getting married. Unfortunately, unless you have a specialty insurance company where the cars is insured for what it is actually worth, they are going to try to screw you by using Kellys Blue Book or whatever to low ball the value of the car.
 
Oh wow that sucks! Lucky no one was hurt and the wedding went as scheduled. I`m hoping the insurance company will do you right. Very cool car and hope its better than new when its fixed. Good luck!
 
This car was intended to be my commuter, so Hagerty (I think?) is out... I have State Farm and they have generally treated me well. I was recently rear ended in another car and that took forever to sort out because the person that hit me didn't have insurance and wasn't driving their own car. This should be more straight-forward, but so far the person that ran the red light isn't responding. I think I'm in for a long fight and likely a poor result.

I guess all I can say is if you drive your cars like I do (as in, most days and all over), maybe consider your insurance policy situation before this happens to you.

Man that sucks but congrats on the marriage. I don't know there's much you can do accept get it appraised (based off before pics) by someone that does collector cars and provide them with parts cost? Hopefully if nothing else get a significant amount of the money for the repairs but take totalling it off thr plate right off the bat!
 
Congrats on your marriage. Most importantly, good to hear that nobody was hurt. I have State Farm for my drivers and homeowners but a situation like this is exactly why I have Hagerty for my old cars. If you have full coverage insurance call your agent and let them go after the other driver for damages. If the adjuster tries to screw you over call your agent and tell him that you are going to give him a chance to make it right and if he doesn't come through that you will take your business elsewhere. It worked for me. Good luck.
 
I was hit in my 84 Dodge truck. Insurance tried to total it, and give me $1200 for it. I was injured, and was just going to use my health insurance, but since the auto insurance was being a dick, I put in an injury claim, and hired a lawyer. Got $6000.
 
How did your current insurer determine the value of your car when you put insurance on it? If it was an appraisal then have every receipt possible that was put into the car since the appraisal was completed... they may not compensate for above and beyond since you never adjusted the insured value while putting money into it but hard to say.... If no appraisal was ever done is there any chance you know anybody well enough that does appraisal's that would consider back dating one for you?
 
You may need a lawyer, BUT before you hire one, see what they say, most lawyers want a third of anything and everything..

Now, you should be dealing with her insurance company, did she get a ticket at the scene?


What kind of policy do you have? Do you have "aftermarket parts and accessories" limit? Some policies are worded "a p & a, limit is X% of total vehicle value" and some have a set amount like $1000..

I hate to say it this way but the trick' to insurance companies is be nice, the adjuster comes kill him with kindness, get him to identify with you and be on your side, they can only do so much for you but getting them to do that is KEY...

NOW if you are dealing with her insurance company and NOT your own, and it was 100% her fault, you should be all set. That is about $5K in damage, it would be more if you had finished paint on there, but thats OK. I wouldn't take much less than 5000$, BUT see what they say... and bee nice, I see a lot of guys get defensive and borderline abusive, and NEVER come out ahead, so just be nice, offer him a coffee, have your paper work in order, I would get a few proposals and have some info on parts available and printed out for him, explain to him "I looked up these parts, and printed the out, they are in about the same condition as mine were" and don't miss anything, every nut bolt, washer and gasket, have ti all in order, I know its a little leg work , but you may get a guy that doesn't want to do it himself and will just use yours....

My brother had a custom motorcycle that was backed into, the adjuster came up and he had every part needed printed out and a quote from a local shop to do the work, he paid that exact amount and thanked my brother for saving him some work, he was actually cooking on the grill and he offered the guy a burger and he took him up on it, and when I see what they gave him I was shocked...
 
So am i gathering they somehow found you at fault? You say she ran a red light, but if you are dealing with your insurance company opposed to hers, i'm guessing she wasn't cited?

I once had someone tear the rear bumper off a completely beater dakota that their insurance adjuster noted as $1900 worth of damage...i think i paid $600 for the truck...but i gladly took that check, lol.
 
You have collision on your car with your own company State Farm?
OK, if that is the case I am very concerned that you won't get treated fairly.
What ever they pay, the at fault driver's insurance will still be responsible.
I think the word is "subrogation".
These are insurance companies, after all, and they don't stay in business by paying claims.
I'm afraid the person coming to look at your car will be clueless about what it will take to return it to a "pre accident" condition. (Primer aside). It's a square peg.
And they will say it's "totaled" anyway.
I have been told that the insurance company can't tell you where to take your car for a repair.
But I've also been told that they can give you a choice of shops and you have to pick one.
That seems sort of like "Do you want to use my brother or brother-in-laws shop".
Yea, that work really well for you.
Of course if you are like me, you can do the work yourself. But that is not the point.
I have loged many miles daily on classic car so we are in the same boat on that.
I got hit last year, posted and got some very good advice on here.
Unfortunately, I acted in good faith and went to a local collision shop as I was instructed to do by the other drivers insurance company and got a ridiculously low "estimate".
(I really don't think collision shops can do or want this work too)
Insurance companies must make a living doing this and taking advantage. We don't.
I'm still waiting for the at fault driver's insurance company do to the right thing.
"Get a lawyer" he said.

I do have collision insurance, so I am covered regardless. The accident should be 100% the other person's fault. The police agreed and they wrote up the report as such. I just don't have the report yet (neither does my insurance) since it takes 10 days to process. To be clear, I'm not having any problems yet- I'm just trying to prep myself and get my ducks in a row for the adjuster. Since, as noted above, I doubt their ability to evaluate anything on a car of this era.

As far as the value when I insured it- no clue how they determine that. I had to provide a lot of pictures, and I have a lot of picture showing the progress. And receipts. Hopefully that will be enough. I'll know more in a few days.
 
Dang! Tough news. Glad to hear no one was hurt but seeing all that bent up sheet metal brings a tear to my eye. That is especially true since it's a '72! I own one myself that I wedge a 383 into years ago so I know that m/y well.
 
well #1 if she was cited...take that thing to the nicest restoration shop you can find and get an estimate. she hit you, your vehicle needs repaired...period. If they offer any resistance, have goodmark and AMD printouts (direct from their website where they advertise above retail) and use the most expensive for #1, and the other as backup. I wish you the best, but being it sounds like she is at fault...you will probably make out in the deal.

Listen to me carefully. Your having very bad headaches and your neck hurts and can't think straight. Now, get a lawyer and go to the hospital. Not necessarily in that order.

That's nice of you to say that to a A body owner. And I should talk as I'm a C body guy, but it's all good!
