Wifes car hit by guy test riding a motorcycle

My wifes car, Kia Optima, was hit by a motorcycle that was being ridden by a guy looking to buy the motorcycle and not the owner of the motorcycle. All the witnesses and police said the motorcycle was at fault. I guess I need to call the insurance of the owner of the motorcycle? The rider was taken to the hospital.
The motorcycle hit the fender right in front of the front drivers side wheel, and the rider flew over the hood. I'd guess maybe a 30 MPH impact? He was in pain, but talking. We pray for his recovery. My wife and granddaughter who were in the car are OK. No airbag deployment in the car. I had just dropped full coverage on the car last month, so I guess I get to deal with the other persons insurance?
 
Turn it over to your insurance company. Get all the witness info that you can. Don't talk to his company until you talk to a lawyer. Trust me,
 
Sorry to hear that this happened to your wife and granddaughter. Hope they are ok, but if either one feels ANY pain take them to see a medical professional asap. It sometimes takes 12-18 hrs after an event for the body to have signs of trauma. Its happened to me.
You are probably going to have to deal with 2 insurance companies, one for the owner of the bike and two the rider themself. If for whatever reason the rider does not have a motorcycle license, the owner of the bike, the policy might say covers valid drivers only. If this is the case the owner of the bike insurance might say so sorry to you, sue the people in civil court.
There are so many scenarios how this can play out at this moment just throwing that out there. Id go to the police station and request a complete copy of accident report. If the officer did their job properly, the witness information should be on the report itself. If for some reason its not, I'd try to find witnesses and at the minimum get their contact information.
I got victimized by an officer who failed to put witness info on report. I didnt get my copy until 2 weeks after the accident. So needles to say I got screwed. One of my witnesses moved out of state a week earlier, no forwarding address, and the neighbors did not have a phone # for him.
As it was mentioned above, get an attorney asap. I loathe them big time, they are in it for themselves. I have 1 of them in my extended family and speak from experience.
My accident was a horror story took 7 yrs to resolve. I got some money, no I was not looking to be a millionaire, but be fairly compensated for my time and out of pocket expenses. After all said and done, I barely broke even after attorney got their chunk, blue cross settling for their amount. (State Farm failed to pay for my medical treatment. I loathe that company too).

Hope you get things taken care of with minimal grief and that your family is ok.
 
DO NOT TALK TO HIM OR HIS INSURANCE COMPANY, LET YOUR INSURANCE COMPANY DEAL WITH IT, they have as much at stake as you and are tenacious.

Does CO even require insurance on motorcycles?

FL does not and a LOT of bike owners don't have it.
 
I can only say this after being t boned 2 times and got nothing from it except a mountain of medical bills. Even after going to court and winning the cases and in one case the person even spent 45 days in jail. GET a lawyer and your insurance company going on it today. Never sign anything until your lawyer says its ok. Remember this the bikes insurance company will plead no fault and will only offer to repair the damage. They will also try to put the blame back on you if your witness can not be found. Next you must have your wife and granddaughter look at from a doctor if the im pact was at 30 mph they could suffer headaches and stiffness later. I also know the lawyer can look at the state regulation and if either one the bike owner or the rider doesn't have proper insurance you can also sue the state. Also remember he was just driving so the owner of the bike is going after him to repair the bike and your car when it is both there fault number if he didn't have the right license that is bad for him. If the owner of the bike didn't have him sign a waiver before riding it this falls back on the owner. I could go on but the last thing i want to say is if they own a house sue that insurance company for the most part the house will have more insurance than the car. I got more but the forum doesn't have enough room it has been a 15 yr old battle and lots of so do it right. Remember there is never a small wreck.
 
Since you don't have collision coverage on your car, you will have to file a claim on the property damage coverage of the MOTORCYCLE' s policy. As long as the policyholder gave permissive use, which it's apparent, that will cover the damages..Make sure you have the police report and any other witness statement, don't trust the other person to be truthful to their company. Take the car to a reputable body shop, OF YOUR CHOICE, do not use their referral shop.

That's how it works in NJ. My daughter was stopped, an older woman turned right into her. No injuries. Woman took full responsibility. Didn't even bother with a police report.
I called the woman's insurance co, filed a claim with them, they sent their adjuster,
wrote up the estimate right there and cut me a check for the full amount, no deductible holdback. Said if there's hidden damage, have the body shop send him a supplemental estimate and they will pay it. Happened with my son once too. Basically same scenario.
