What the Duck! (Boat)

I've been in worse conditions than that shown in the video, more times than I want to think about in my 23ft. boat, coming back from ocean fishing trips. Fast, offshore moving thunderstorms sometimes hit you unexpectedly and you're not going to turn around and run with it, getting further away from shore.
I would be interested to hear if passengers started moving forward in an attempt to stay dry. The bow of that boat looked like it was lower than the stern.
 
Got to blame this on the Captain. Out in wrong conditions, did not order life preservers on, ducks have a serious bilge pump system(or at least the WWII eara ones I have been on) that are connected to the engine... Have had great times on ducks in New Orleans. Got great mammaries of a bunch of strippers and jugs of wine on lake Pontchartrain. I am on the water a couple times a week fishing, have a weather app on my phone with alerts as does every Capt. I know.
 
This duck was not out alone and was not that far from port when it sank. Supposedly nose first and sank.
Was working with one of the grandsons yesterday. He has been on tours with this same line before. I asked about the life jackets. There use is covered before each tour and appropriate size furnished per passenger. Its optional if worn.
I would think passengers would have signed some sort of stupidity or fault waver before boarding.
Something like that of commercial airlines that only carry shuttes for the crew.
