Parts ruined in shipping, FBBO Member refuses refund.

Just an observation, there's a huge difference between "Parts ruined" (title) and "Never delivered" (posted). If you got a tracking number, then the seller honored his part of the sale agreement, and it's up to the shipper to tell you where the package is. This is entirely on the shipper, not the seller. After a reasonable amount of time, the package is considered lost. If they lost it and can't locate the package, then the seller would have to file a claim with the shipper and seek insurance costs (hopefully, for $700 someone insured it??). At that time he can refund your money, but why should he refund your money when the parts are, technically, enroute? If they do show up, then you have the parts and he's out the money and the shipping charges. Just sayin....

If this was a cross-border deal then the insurance issue may be questionable. The insurance is the value of the item which can result in duties or taxes to the buyer. In this case no duty but possibly tax. So if the buyer doesn't want to pay the tax he may have declined insurance from the seller. If the item is not delivered, someone - buyer or seller - needs to get a hold of the shipper and find out what the hell is going on. I have been in this predicament twice, once receiving an item from the US and once returning an item. Customs can be a real bitch when then want to !!

I have gotten notices from the shipping company that something was damaged in transit and they weren't going to deliver it. It can be both.

ALWAYS insure for value, especially when using freight services. Used items are only covered for ONE dollar per POUND unless a declared value is entered on the bill of lading. I know that too well, as Yellow Freight severely damaged a pair of $40,000 aircraft floats on me by putting numerous fork holes though them. Seller didn't declare value and I got $368 based on weight and then had to fix them myself.

As to the OP, as many have asked, was the paid value declared on the package??

Recently had a FEDx package that said not delivered for a week. It was eventually found at their warehouse but had to be picked up due to multiple delivery attempts (while we were home and it was scheduled, so BS) but we got it. Also have had one instance of purchasing a bumper from a fellow member that was sold as excellent that showed up with an irreparable dent and images provided to the seller. Seller refused to return payment after multiple asks. We just walked away from the situation.

Always pay the sellers 3% PP fees if they ask for it. Cheap insurance for situations like this. Hope this situation gets worked out for you.

Seems to me that damaged or not, they have been paid to deliver the item. If its damaged because the plane crashed during landing, maybe I can understand not delivering it !!

OP is calling out a fellow member on here, yet hasn't answered the basic pertinent questions
that anyone would need to know in order to support his outrage.
Again:
1. Was the package ever delivered, damaged or not?
2. Was it insured? If so, by whom and for how much? Was a claim filed with the shipper?

Too many stories out there of people stealing packages off porches, too, remember....

Actually, he's quite good. Very fair and will bite your head off in a heartbeat.
If you have a problem, go to CONTACT US and he responds within 24hrs, unlike my Seller here.

I meant the web site of the seller, in which case I can understand the problem.
Are you talking about the staff here and contacting them?

Did you pay the extra for insurance ?
Hate to say you tried to say a buck on PayPal makes me think not !
The seller did his part you need to go after FedEx ! Damaged or not they need to deliver it ! Something sounds fishy !

The seller has been a member here for 3 years with only 185 posts ???

That doesn't mean anything.
I've been a member here longer than that and only have 151 posts...err 152 now. I just don't post very often. I don't post often on any kind of online media. That doesn't make me an unreliable person. It just means I don't talk very much.

I feel it is the sellers responsibility to get the part to buyer... period
you pay, you should receive something!
so if the buyer got nothing
the problem is between the seller and the shipper.
the buyer did NOTHING WRONG ON HIS END OF THE DEAL
one of the 2 should be fessing up
usually the shipper bends you over and in the end
the seller should take it in the shorts.

I have shipped fragile stuff , it arrived broken
and I made good on it and sent another.
it was on me because I should of known a 800 pound gorilla was going to kick my package across the parking lot.
into the delivery truck.
another part was broken in transit and I refunded the money
and told him to keep it.
**** happens buying and selling long distance
stuff i'm not happy with I blame myself for not asking more questions about the part
trust has to go both ways that each side will do the right thing,.
that is how I roll
but I like to sleep at night knowing that someone doesn't think I'm some kind of crook for a few lousy bucks.
.

hopefully this mess will work out

WRONG.
I would be much more likely to trust a member that has been here awhile and has a moderate post count. 185 posts sounds like all he does is sell stuff, maybe he doesn't care about anyone but himself enough to offer tech advice.

I tend to agree with Kern. If you have a business whom do you trust more - the guy you see and hear from on a regular basis or the guy you hear from very occasionally? I know what my thoughts are having dealt with this issue many, many times. It’s not that I don’t trust the OP it’s just that if they’re not a frequent flyer I don’t know.....
