Andy Lipka is facing a tough battle with his Homeowner's Association: lose the pickup truck or lose the home.

Lipka's 1965 Ford F-250 is his pride and joy. He describes it as well-running and "pretty close to perfect," despite the fading Tropical Turquoise paint and its bouts of surface rust which peppers the entirety of the truck.

Lipka's HOA considers the truck to be unfit for his neighborhood in Chesterfield, Missouri. The HOA has ordered Lipka to remove the truck, citing bylaws which prohibit vehicles with "moderately severe body damage" to be parked at the driveway of any home which resides in the Woodfield Homes Association's footprint.

Down the road about 12 miles from my house. They have some real uppity people living in that subdivision. We have an HOA in my subdivision also, but , I'm on the board and have stopped them from bitchin about those of us with loud cars!! I pulled up to a meeting in my coronet and they quickly realized it's not a bucket of bolts, but a truly expensive piece of rolling art. His truck is very nice, they just don't understand the patina paint. It's a load of crap those people are trying to pull on him. I hate to say this, but like my subdivision once you reach a certain price point it's not a bitchin ride for some unless it has the letters BMW or AMG in it. It's been going on for him for awhile. It sucks!!!!

HOAs truly suck. Usually just ran by a group of egotistic a-holes. Should be illegal
 
I hope he wins (Semper Fi). That truck does not have body damage, it has a weathered finish. The words moderately severe are an oxymoron. LOL The guy's home looks to be very well kept.

You being a Board Member I applaud your dedication to the Hobby. Sounds like a very nice ride you have there. But I have to say this...HOA's to me are nothing but pilfering Leeches promoting Draconian By-Laws, Covenants and Conditions that are completely self serving and really a total waste of time and money. I have one as well, and these Pricks seem to feel it is their right and duty to judge others without themselves being judged. They are the Judge, Jury, and Executioner when it comes to these types of issues. Arrogance can only go so far and eventually they will get their just due. I pay my fees on time but they are still of the opinion that they can dictate as the please. Weeds barely visible from the street yet notices go out for this type of thing. The bottom line is this when it comes to HOA's. They do not pay my Taxes and Mortgage payments and really have zero legal recourse when it comes to to my property. They can pull all this nonsense as the want but when it comes to a confrontation, they will always loose in the end. Those that bend to their whims give them the latitude to over step and over reach as they seem to continually do. And I might add...The HOA of my community are in fact right now under a Federal Investigation for Fraud and Miss-Appropriation of monies going back over a very long period of time. I'm only on the board because no one wanted it, my neighbor who is on the board short of beg me. I hate it to!! I can't tell you how many times I have voted against them!! I told them if you don't like my way of thinking, vote me off, again, no one will take the job, so screw them!! I was raised in a home with a outhouse, money hasn't changed me!! I have one year left and my wife has told me I'm going to have a heart attack dealing with these ********, she's right, I'm done....
 
why belong to a HOA its just stupid rules and regulations :wtf:

Back them into a corner, force them to define "moderately severe body damage" with a dollar value. Then have THEM get an appraisal of the "body damage", not the "paint", the "body damage". If it doesn't meet their dollar criteria then its a done deal !! He needs to push back - everyone has rights.
 
BOAs are basically a group of people who have no control over their own lives so they create their own little empire and boss everyone around.
They are the first to complain about govt regulations.

I'm not familiar with these groups so I have to wonder, just how much authority do they have? Its an "association", not a governing body. Were there any agreements signed when the property was purchased? I'm familiar with covenants ... the last home we bought was near a fairgrounds and when you purchased the land you were bound by the covenant to a) not complain about the odor from the horse barns and b) not complain about the noise during the annual fair. Honestly, the neighbor's dog was a bigger nuisance !!
 
Get a "historic vehicle" plate, that might have an impact on any legal action they might take. They should consider themselves lucky he doesn't own a rat rod !!!

Your HOA was always nice to me on the phone the half dozen or so times I had to call them to report your parking habits and wrenching on the GTX.
 
The subdivision my sister in law lives in was giving this guy hell over his yard. He did have grass 2 foot tall and crap everywhere, but he got them, he mowed his yard and painted his house purple, I mean deep dark PURPLE everywhere, including the gutters. They went after him, but , there was no clear cut rule on the color of your house and they decided to get off his back. Five years later he painted it white!!! LOL. First time I saw it, I asked, what is that about, she said I don't want to talk about it!! LOL.
 
People who opt to live in an HOA reap what they sow.

I will never, Never, NEVER, N E V E R live within the jurisdiction of an HOA.
 
I have yet to meet someone that will truly say they "love" their HOA.....

It all falls of the choice of where and how you want to enjoy your home of choice....
