HOA sues over a 1965 Ford F250 pickup truck with original patina

Anarchy? Not hardly. But hoa's are like another layer of govt. And as this example shows its too much.
Hope the guy shoves it to em.
You are using one example to prove your point. Your research is limited and biased because you would never live in one. There is no problem with that because that is a personal choice. For others that made the decision to live in them is also their personal choice. When they make that choice than they have to abide by the bylaws.....Problem is people don't spend the time to research a potential community with an HOA. They fall victim to the nice community with beautiful homes and buy into it. Then they realize what all is involved or they try to bend the rules......

The truck situation is just nonsense......It is just someone in that community with an Ax to grind I bet....

I had my run ins with HOA. what I did went through the whole sub division. Found everything I could with every house. Then found out who was over it. And I be damned if the woman had an above ground pool. Needless to say when I was done she had no problem with my enclosed trailer sitting in my back yard. Hell I didn't even have to pay my dues.

We had a an HOA where I bought my first house and despite the well meaning "concept" of them, they absolutely suck! Every guy/person I know that lives in an area with a HOA hates them, if they were so well meaning this would not be the case. Again, I think the concept of the HOA is probably ok (like socialism or communism), but the actual application of it is deeply flawed because it puts one group of people over another and it is inevitable that there will be issues when someone in charge or in control (not always the same thing) begins to make decisions for everyone. I concede that there are probably some good ones out there but I don't know of any, nor have I heard of any but that of course doesn't mean good ones don't exit. Funny thing is, the only people I have met that like the HOA are in charge of it..

All this said, I do agree that life is a choice, I made the choice to move to the county where HOAs do not exist.

I find that an HOAs main problem is they’re run by neighbors that get on a power trip and usually have no experience running a municipality. Most of the time it’s a thankless unpaid position that most people don’t want so ineptness creeps in. I try not to complain too much because I won’t run for the board to effect change so I can’t bitch. The population density issue in CA and all the master planned communities warrants some type of oversight so unfortunately I agree that it’s better to have them than not here.

Our HOA is not overbearing. They just add to what the city has already done. You can have all the cars you want, in the driveway. If it's not registered and has flat tires, then there's a problem. We even allow ATV'S on our 18 acre common ground that has a pond for fishing and party till the cows come home. It can make a difference who is in office, that's why a majority vote is needed. To be honest, that's one reason why I'm on the board, to keep the pricks in check!! I've lived there for 11 years and so far so good, basically. Just saying.

I would concede this point and like I said, the concept of the HOA is good but the execution is flawed for the reasons you point out. I just rail at the thought of being under one due to my experience (which really wasn't horrible, just a PIA). I will say that like many things in today's society, most people don't really know what is in the covenants and bylaws of the HOA to include those running it. In my case, I had the HOA saying I could not do something but after actually reading the documents discovered they were completely incorrect. After a little debate, they fell to something akin to "because we said" at which point I essentially said "too bad". In the end, they chose to let it drop but it was the impetus for me finding someplace else. Now I have 5.25 acres, 2 40x60 shops, a 100 meter rifle range, etc... all good.

I have found that in most cases, birds of a feather flock together, so most people that live in one, see eye to eye. But like our country as a whole, there is always someone that wants to pee in your coffee.

Hmm....sounds just like my subdivision. No hoa. County regs. It must be licensed and if not must be under a roof and a cover.
That's my point. If the local govt regs aren't good enough get them changed. Don't add another layer of bureaucracy that can cause more problems that they solve.
Against hoa's? Damn right.
This guy has a truck with an imperfect paint job.
People need to pay attention to more important things. Its not derelict. It runs. It is driven. Where is the problem?
In the minds of the little empire building Napoleons on the board.

Maybe if you look at all the posts here I believe no one disagrees about the truck situation.......

We get it you cant stand HOA's.......Its not for you......In my community we have a lot of benefits from our HOA and the fee pales in comparison to what they handle.....Again, researching one properly, talking to neighbors prior to entry can educate one on what that association is about......

Granted, I won't fill my ego labeling my vast estate:D

Boo-hoo. Does anyone buy a house without inquiring about possible HOA? I wouldn't ever move somewhere that has one..this guy should have checked the rules first. Yeah sorry no sympathy here....any house I've bought or even rented, HOA was always asked about and/or disclosed by the realty agent AND in any contract. Never heard of anyone being forced to live where there's one? Any of you that live in one, cool, I hope you understand the rules? Buy the ticket, take the ride....

Many homes ago I came home to a neighbor with a swing set with a 2x4 across the top of it he was using as a cherry picker in his driveway. It had a small block engine hanging there for 10 days and a 4 foot puddle of oil running down the driveway. After he took the engine down the swing set stayed there for 4 months and so did the oil which by now had run down the driveway and down the street in front of his house. Say what you want, that bullshit. I didn't say a thing, I moved!!!

I did ask about HOA before I bought my house. Lawyer said at closing didn't seem to be one. Realtor had no clue as house had been foreclosed on. But after I moved in less than two days they taped rules to my door and had the NO TRAILERS highlighted. Which I was OK with if everyone else was with in the rules. Out of 150 homes about 30 of them had stuff wrong. Not that I cared. But when the bitch that was over had above ground pool. I plainly told her Ill move my trailer but your taking your pool down. and her husband was running a business out of home which was not allowed.
Again had run in as I was building a 12x24 screened porch. They stopped by and asked if I had approval to do that. and that I was to send them blueprints before I did any work. That didn't go over either...... I told them where to stick their rules. and that's when I was told I had no dues anymore.
All the neighbors was ok as they said our house went to being one of the worst houses to one of the nicest.

You have a case. All parties involved did not disclose there was a HOA.
I wonder if the guy here has in his HOA rules anything about paint on vehicles. A poor paint job does not make a vehicle derelict.
I wonder how many people there have cars with peeling clear coat?

I'm sure there is no paint ruling, per say, I'm sure it's the fact that it looks like it's rusting away to some. Of course it's ridiculous!! It's Chesterfield!! Nothing more than a bunch of wannabes. My daughter flips homes in Chesterfield and wildwood the rules are crazy, but so is the money she makes. I worked on clients condo in Chesterfield, next door to Ozzie Smith's condo. 3700 square feet, 1 million dollar setup five years ago. You go through a gate with a guard just to get in. They don't allow a truck in the driveway and I don't care if you paid 60 thousand for it. That's just how the other half lives. Go there and tell them you
don't like their rules and the police will show you the way out. Chesterfield has two sides, wannabe nice, where he lives and the you don't belong here nice. At the end of the day, money talks and bullshit walks. I still will always stand by him and his truck. Again, alittle bit of money hasn't changed me. I sued the state once back in the mid 80's, it took the right lawyer and a willingness to spend all you have just to scare them to back down. I won and to this day they hate me. The only thing that keeps them from spending tax dollars on getting even is a judge's order against them. That live....

Around here there are variations of a common sign seen in the windows of foreclosed homes.

It reads something to the tune of "this property is not currently for sale or for rent, anyone with contact information for a local HOA if there is one should call.........."

That suggest that banks and lenders have no clue if a given property they have financed and come into repossesion of, is inside of an HOA.
