anybody take Fedex to court over damages?

They kept sending boiler plate responses that say they needed more photos. After sending photos three times, I requested they go in person and inspect so they could see that it ws packaged according to specs. They declined.
Fedex's confidence leads me to believe there is something I don't know as I threatened to take them to Small Claims. Will they say:"Oh no your Honor, it is that evil eBay, not us"?
The State Insurance Commission says that Fedex self insures, so they are not accountable to the State. Going to file a complaint with the State Consumer Protection office this morning.

I had to sue a bank once for similar denials over a cashed check. They debited my account but didn’t give the money to the check recipient. They never even showed up in court, so they lost. Called them afterward and they simply said mail them a copy of the judgment and they’ll send me a check (which they did).

Unfortunately for you though, your shipping documents probably have fine print on the back that says something like unless a declared value is made at the time shipment was picked up by the shipper, they will only reimburse at $x per pound. Did you declare a stated value?

My friend went through something like this on a $10K X-ray machine. They “lost it” in shipment and since he didn’t declare the value at the time it was picked up by the UPS truck, he only received a couple hundred dollars back. My friend even had a relative who was a VP at UPS help him.

I bought $800 of "insurance", so I would assume that is a stated value.
 
Just last week, I had to ship some relatively expensive items to a customer of mine. Been shipping with Fed Ex domestically and world wide for over 20 years now.. I shipped this particular package domestically at a Fed Ex office location nearby that I use quite often. A standard shipment comes with $300.00 of insurance. If you want more insurance, you must declare at time of shipping and pay additional accordingly. With anything expensive, I typically pay a bit extra and require a direct signature of the recipient. I decided to protect my self and added the amount of insurance to cover the full value of the items sold. I was surprised when the agent asked permission to open the package to inspect the contents. I said " Well this is new, why did he need to do that, never had to before.. " He said that he had to open the package to inspect the items before he could apply the additional $ 2,000.00 of insurance I asked for. He stated that the reason is the ever increasing number of scam insurance claims against Fed Ex. He said this was now FedEx policy.. He went on that people are shipping relatively cheap and worthless items to a co-conspirator and insuring them for large dollar amounts. The recipient could induce damage to the package, claim that it was never delivered, or as is the problem nowadays, stolen off the front porch after delivery. Fed Ex which self insures would have to pay out on bogus or real claims. If the agent does not certify he inspected the contents, bogus insurance claims are charged back to the local FedEx office depot that accepted the package for shipment... so he said.
 
I just had some tires I ordered show up Fedex today. I was horrified to see them show up not in boxes. They shipping invoice said boxes in my email. Anyway, I had them put on this afternoon and they are holding air so far.
 
Good luck on your quest. There very much the same as UPS. They have there own underwriters that determine value even if you have a insured anount .
 
I've never received new tires in boxes.

Always banded in pairs.
