Are you saying you sent the 2nd one back and that one hasn't been replaced?

Not trying to defend Passon, but it looks like he tried to invent/market something new and cool, but it didn't work out.
 
SST. Passon walks on water here. I don’t know why. My pals 855 has more miles on the truck going back and forth to Turkey Choke, Pennsylvania from California than in the ‘Cuda.
 
God Bless small business and Mopar craftsman. BUT, you gotta know to when to under promise and over deliver. Jesus Chrysler.
 
Wow, I just read through the whole 8 page horror show!
Maybe it's time to take a week off work and drive down there and stay around until you can drive back with the new transmission in your trunk. Don't give them the old one back - sell it (noting the issues) and keep the money as compensation.
Don't give up!

Good to know, should my 855 break behind the 540 I'll have one day hopefully before I die. At least I've taken the first step towards the 540, by putting the deposit on the BME aluminum block.
So far my 855 has been great under all circumstances.
 
Wow that's some screwed up stuff going on! Glad I got a driveline shop I trust that's never caused me any concerns

I have been checking out the "TKO" transmissions for 10 years probably, and I always thought the display shifter/transmission shifted nicely compared to the "helicopter joystick" BUT I honestly have no complaints about the shifting speed or accuracy of my Passon reworked 833 (3rd popping out is another issue) nor the Hurst shifter that came with the 855. At the track, getting my 70 Roadrunner down the 1320, especially the first 60 feet, is a full time job, and one that I have lots of room for improvement.
The point I want to make is that although I love the short throw and extremely precise "snick/snick" of the TKO, I am doing just fine with both the 833 and 855 where shifting is concerned.
Now I specced out a BAD *** TKO600 for my wife's GTO, and spent the extra coin for the "White Lightning" shifter, that looks like the epitome of shifters, and I want it to be, for her sake. The more she enjoys driving, racing, and shifting her GTO, the more likely she is to have fun and that hopefully translates into me having more fun, and us doing "car stuff" together.
I am going to get a REALLY good idea of what the TKO is like, so maybe that will help ease my mind should I have to look at something different in the future.
I honestly don't know the ins and outs of the "T5, or TKO600, or G-Force, Jerico", yada yada..

One of the main reasons I went with it is I have a bench seat, newly redone, and I want to keep it.

The first one went back twice.
The second one went for testing twice, from GFI to WY.
GFI told their biggest lie on this.
On Friday 12/27 I recieved an email that it was on a pallet with 8 other trans waiting to be shipped to WY for testing.
On Monday 1/6 I received another email stating all 9 trans, with the same issue as mine, passed testing, and all they needed to do was send me a side cover with a heavier spring.

That's 9 days total to ship, unpack, r&r, and test 9 trans, minus minumum 2 days shipping, 2 Sundays, 2 Saturdays, and New Year's day.
Even if we include Saturdays, that leaves at most 4 days for 9 trans.
I replied, that's baloney, for that reason and I was offered a new trans, and I never heard back again.

To clarify, from what I gather from the other two parties involved in the A855, Passon didn't invent anything, but wants the credit and the sale $ for it, but none of the responsibility.

I used to think that as well, and there are probably multiple threads where he is praised, but the reality is far different.

No presence on Mopar forums in years, that I can find, always claiming he's building that 5 speed, according to GFI he's not and never did.

But still selling it, defective.
 
So what are your plans to resolve this situation? You've outlayed a lot of coin for a defective product. You've done the right thing so far by being professional in your dealings with them and you have a good documented history of everything that has happened - if you aren't prepared to go on a road trip to sort it out maybe you should hand it over to a lawyer.
Personally I would take the time to drive down there first and try to sort it out face to face. Many people are great at fobbing people off on the phone or by email, but when you talk to them in person most people are reasonable and can be persuaded.
 
John has requested an opportunity to make it right, not sure if you read through everything, but he invested, doesn't own, does the testing, said they use cheap garbage parts to save money and he has someone who makes good parts, but he doesn't own the company or product so he can't make them not be losers.

After that, and I'm not waiting indefinitely, I have a timeframe, I'll be taking other steps.

It's clear they calculated it's cheaper for them to ignore me and the issue, civil lawsuits cost money and each jurisdiction has their own limits. I know mine is less than what I was robbed.

Every time I type that out, they, Passon and GFI, have decided to ignore a customer who spent thousands, it's just, well, believable at this point.

Could anyone on here do that?
And the proof is documented, I've been overly patient, reasonable, and understanding.

Driving to both places and spending time there is an option.
I firmly believe both will be completely uncooperative and unwilling, it's the reality of their character.
 
I was one who praised Passon for what I thought was the courage to conceive of, engineer, and build a very strong transmission w/an extra gear and put it in just about any Mopar with no cutting.
I know he's been through great personal strife.
After reading ALL of your posts, I'll just say this is his last chance with my 833 that I haven't seen in over 2 years, thank God I haven't required service on my 855.
Having said that, I am still going to race with my 855, including once I get a much more powerful engine in front of it.
If it grenades, I'll already have a different replacement 5 speed selected, and send the 855 off, and once it's fixed, put a For Sale sign on it..should that day come.
I'm not going to give up my 3rd pedal, 5th gear, nor an engine that has some better than average power output.
 
Yeah I did read it all and know you are pinning your hopes on John coming through with the the transmission, but you also stated on April 25th John was getting a new transmission on a pallet with a 3 year warranty for you, and it's nearly 2 months later and it still hasn't happened.
I'm not busting your balls over this...it sounds like John has a lot more integrity than the other parties and you are being a reasonable guy and giving him some time, but due to the financial situation he's been left in I hope he comes through. It sounds like you're being bounced around here there and everywhere, and time is passing by with you still in the ****.
 
66 Sat, you are correct, on all counts.
Don't forget, a 3 year warranty isn't worth anything if this whole thing goes under, or worse, John is out and it's handled by, or should I say denied by, GFI or Passon.
 
If you don't get a result in the timeframe you've allocated and you don't want to get a lawyer fully involved due to the cost, you could try a well written legal style letter referencing the appropriate laws (from the quick research I've done it would probably be Implied Warranty of Merchantability), and concisely setting out the situation to date with dates, telephone calls etc. I've got a letter somewhere which I used in the past with Ford following an issue with a new demo car that we had some problems with and they ended up giving us a brand new car after I sent it to them. I'll see if I can find it tomorrow and I'll pm a copy to you if you like, or I can knock up a new one if it will help. The squeeky wheel gets the most oil and if Passon and GFI realise you aren't going away they may just see reason and refund your money or come to some other agreement.
 
I'm sorry to hear all this. I just purchased an A-855 and installed it. I only have about 250 miles on it but it appears to be working fine, at least so far.

Jamie Passon has always been great to work with for me; he has stood by his work and his word. Having said that, it is impossible to deny your bad situation and it pains me to read about it. First, because it sucks for you - spending big bucks and then living a nightmare trying to resolve issues. It also pains me to hear about the transmission issues obviously since I now have one. If I start having problems with mine, I worry about getting it fixed. I am willing to be understanding about slow delivery due to parts issues, etc., but poor response to warranty issues is another matter.

I truly hope this works out - this is a lose/ lose for everyone involved.
