I had a radio stolden when my car was at the trans shop. They ripped the IP apart to get it. The trans shop's insurance covered the cost including a new IP. I had to do the part hunting since it was a 70 MY. Just saying the business is responsible for the vehicle when they are performing work.

If the shop fixed the window and you aren't claiming that......why not say the parts were installed on the car at the time?

Because that's called insurance fraud. People go to jail for that.
Insurance companies defraud us all the time.....who goes to jail for that? It's a cat and mouse game that they play and win at....

He is Liable for the loss. He had better have what's know as "Garage Keepers? Insurance to cover any and all Liability that is a result of something like this occurring. It is also know as "Baileys Coverage". Any time you have contracted for work such as in this case your car, and he takes it in, it is in his "Care, Custody, and Control". I doubt that his Insurance Company would have told him no unless he doesn't have Insurance and therefore is running a non-Insured operation. I was in the Insurance Business for 8+years and would sell the type of coverage packages to Garages and Shops. Something isn't quite Kosher here and I would most definitely get yourself a Lawyer. "Do Not Take NO For An Answer" otherwise Sue his *** off as he probably is non-Insured. Also your auto and homeowners Insurance will not cover this type of occurrence...cr8crshr/Tuck

i know it's a different country but up here it his baby. had a similar thing happen to me with a snow machine, thunder cat, a couple of years back. it was at the dealers shop for something, can't remember, and it was stolen with a couple of other ones. the owner and i knew each other but not a so-called friend per-say. i approached him about it and he said his insurance co said no due to some reason that didn't make sense to me at the time. thought about it and talked to him again and got the same reply. told him i wasn't done with it and went to a lawyer. it was a brand new 10,000,00 dollar machine with maybe 7-800 miles on it. at the end of the day i got 8,800.00, used, and he had to pay the lawyers $$.
moral of the story is approach him one more time offering to settle and he can keep it out of his insurance or you are going for the money. period. tell him due to being a so-called friend its his call. a stranger wouldn't get the choice.
p.s. had to buy another machine to finish the season, another dealer, lol but the money did come eventually.
I've sent him another email and asked him about his insurance. Only way I am getting money from him is through a court and that will be a huge hassle. He lives 180 miles away in Washington and thats where the theft happened. As far as he is concerned he has washed his hands of it

And this guy is/was a friend...lawyer-up if you can because from the looks of it I wouldn't be too surprised if HE had your parts...tough break man,I sure hope it works out for you...good luck

I would think if the parts were on the car when you took it to him to have it worked on then he or his insurance should pay for replacing them. If he had to remove them to perform whatever work you wanted him to do, that's part of the work process, he would then install them back on when he was done. I would push his insurance company to pay. There is a fine line between friendship and business relationship. Many business's will screw their friends to make a buck. Don't know how long you have known him, but I would think he would do whatever he could to make it right.
Sounds pretty cut and dry, you either walk away or lawyer up. Me personally, I can't stand to see a crook get away with anything "especially the Ins Co". I can't stand Ins Company's, they rob you all your life and bitch if they have to spend a cent. I agree with these guys "something sounds fishy".

I filed a claim with my homeowners and then I get sent a letter saying they are going to drop us. But we complained and our agent stood up for us. Now we cant file another claim for at least 5 years. I really dislike insurance companies.

I agree with roadrunnerman.
I could understand his insurance not being responsible if it was a box of personal items you left in the seat, but these are parts he removed from your car (which I'm sure he charged you for as well!) to facilitate other work. That makes him responsible for those high value components under his care. If he would have put them in the trunk (out of sight!) maybe they would not have been stolen!
Like others have suggested, inform him if he is not going to make it right, you will turn it over to one of the 'ambulance chasing lawsuit firms'. I don't think too much water has passed under the bridge since you just recently got the car back. Explain to them what you are looking to get out of it (cost of parts I assume) and they can have the rest. Sounds like a shut and closed case for a 'lawsuit looney'.
As for the friendship...that was over when you got the car back minus all the pieces, whether you wish to admit it or not.

I hate to be the bad guy here, but who's idea was it to have that stuff sitting in sight in the car? Before I dropped my car off at the shop for the engine change, I pulled the stereo, rear speakers, and CB out, and ran some lose wiring out of the stereo hole so it looked like the unit had been ripped out. I also saved up a couple week's worth of fast food bags and cups and dumped them on the front and rear floor and on the back seat, along with some empty soda cans and some old newspaper circulars. In short, I made my car look as unappealing to thieves as I could get it, and anything worth stealing was locked up in the trunk.

Then don't be. We all already know nothing bad ever happens to you because you think of everything and know all the answers. No need to constantly rub it in. Everybody already knows you're perfect. Perferct at what I will refrain from saying as I'll get an infraction.
Before you completely walk away. I'd suggest you get a lawyer ( I hate Lawyers) to write a letter to the insurance co. They will think twice about denying a claim when the correspondence is in writing. You might be amazed at the turn around. The right lawyer will write a letter for a fair fee. That will be you only additional loss.

not sure where the shop is....but it might be close enough i could go poke around....kinda got burned by a member using the Paypal buyers protection screw the seller policy so am on a rampage for thieves
