A friend of mine was ordered to sell his boat, vette, and 2 motorcycles in his divorce. I remember thinking "wow he is taking that news pretty well", until I went to pick him up at his fathers house and seen the vette drivetrain, interior, wheels, and bonnet, 2- 250hp mercs, boat seats, electronics, etc, and the front end, sway bar, wheels, body, and a ton of bike parts filling the garage...
I asked if that was legal and I'll never forget his reply "legal and right are hardly ever the same thing"... She cheated on him, never worked a day in her life, always drove a new car, had her hair and nails done all the time, $500 purses, etc.. then instead of her being punished for being a cheater, the judge says he has to keep her in the life style she was accustomed too. Well his business was in his parents name (he messed up, its was about a year from getting transferred to his), and he was fired just in time, she had a bank account with a couple hundred grand in it from when her father passed, he got half of it, he let the divorce atty sell the remains of his toys, and he said all together he lost about $100K but her lawyer charged her most of it.
He is doing very well, dates a women 15 years younger(says he will never marry again and when she gets close to 7 years living with him will get a prenup so common law cant **** him), never been in better shape, owns a million dollar home, his fathers business, doing very very well. She bounced around a couple biker bums and now is half drunk and probably on drugs by the look of her the last time I seen her...
Marriage is tough, you want to protect assets but not think about divorce but its just the way it is. Protect yourself but be fair..
