Taking Fedex to Small Claims Court

I'm not a lawyer., so I have to muddle through and hope for justice. I would greatly appreciate any help if you could give pointers to clean it up for me. I tried to be brief, so as not to lose the Judge with too much.
 
A couple of things I noticed in the thread:
1. If you're spending $5k in shipping each year, why do you not have your own account
(with UPS, for example)? They'd come directly to you to fetch at that point.
2. I use the local office supply store to ship sometimes; they're UPS approved.
They provide their receipt AND an official UPS one including tracking as well, just like
you'd get directly from UPS.
3. Post Office does a decent job and offers similar as well - and the kicker is, at least
in this region, that they also have a contract with FedEx to deliver their parcels occasionally
as well!

Again, the difference:
UPS isn't franchised and has their own employees.
FedEx is franchised and has their own employees PLUS the franchise has their own as well.
Huge difference. BIG difference.
 
FedEx seems OK north of the border. If I am ordering parts, I find that they are at least trackable, and seems to generally get here with decent speed. USPS however is a black hole. I ordered something from a vendor in WA, like a stones throw across the line. They only offered USPS shipping. Well, this thing goes on the magical mystery tour. WA to Los Angeles in 2 days, then shows "Delivered - Handed to person" in LA and no further tracking/movement/customs clearance at all for over 20 days, then randomly shows up with no notice at all about a week after that. This is only one example. The particular piece wasn't cheap, so I was happy to have it, but I almost want to just fork over for FedEx or UPS to avoid having to wonder if what I order is even going to make it.

I have an account, and tried to deal with this while signed in, same results.

I'm more mad at the attitude. Things get lost, things happen and I'd like to think I am capable of sucking it up and moving on, but how hard is it to say: "I'm sorry this happened" ? "We may not be able to find your package in the end, but we will try". They actually told me I was mistaken and had not dropped it off.
 
I just put that propeller to Holland on the Fedex truck and he hadn't even made it to the gate when I got the tracking notification that it was picked up. Can't beat them in Canada, UPS I'd be lucky to get a notification that it was delivered, let alone picked up. "

I hear you, I just sent a nice camera tripod to Canada... holding my breath. Shipping was more than the Tripod. From this side USPS reads: "Scanned in Chicago", I won't see anything else until is says: Delivered.
 
I had my fair share of issues with Fedex.....never choosing them again as a shipper.

I had a package take 5 days from USA to NZ. It was pre-cleared from Customs, and went straight to the local depot for delivery....where it sat for 14 more days. Several phone calls to outsourced operators gave me no results. Then magically it appeared following a phone call telling them I would be taking out Fraud Charges against them for non-delivery.

Once you think it has cleared the border you can usually plug the same USPS tracking number into the Canada Post Tracking Website and often the numbers work to see the progress on this side.
 
There my friend is exactly your problem. No way in hell would I send items under those conditions.
Exactly. When I go to UPS and the guy isn't around they are always like just leave it here and you can pay for it later... I say who is responsible if it disappears and I have no tracking? Oh well I don't think that would happen... I just say I will be back with the package when he is here. Once YOUR paid you have some responsibility to make sure it gets into the system.
 
I still don't understand not getting a receipt when you dropped it off to ship. I have sent several cores back to Rock Auto using there mailing label which is with FE, dropped off at the local Dollar General store where they scan it and I give them my phone number and before I get out of the lot I get a text with all the info about the shipment. I've had several issues with deliveries from FE. I ordered some LED bulbs for my shop once and the tracking said out to deliver for a week before it showed up. When I went to get it at the gate the box was torn open and 2 of the bulbs had the ends torn clear off. I took good pictures and sent to the seller so he could get his money back.

That's one thing I learned from traveling international for business for several years. Take pictures of everything. Take pictures of your suitcases before you check them in when flying. That way when you have to go to baggage claim and they want to know what it looks like just show them the picture. Take pictures of what ever it is your shipping with it in the box before you close the box for proof everything is in the box. Take pictures of the package after it is labeled to ship. One picture can save you a lot of headaches. Hope you have a good day in court.
 
Be aware if you do win in small claims court there is no recourse if they don't pay.
 
Fedex working good for me so far. Picked my 62 lb crate up here in Ontario (2 hours N of Toronto) at 3:35 yesterday and it was in the Tennessee Fedex hub at Midnight last night already loading for the UK.
 
suing Fed ex will make your life harder sir. They like to get sued. We had a $12k insurance claim against a driver who was caught on vid destroying our community gate with a branded Fed Ex truck. They are self-insured and we had to file for damages even after they were cited for vandalism. They eventually paid the claim, and the legal fees....but only after 18 months of legal wrangling.
 
I think the OP just wants the satisfaction of winning and inconveniencing them. Self insured companies are the worst because they’re paying out of pocket. It’s always preferable to sue a company that has insurance. Insurance companies are in the business of getting sued and likely wouldn’t want to tinkle around for something so small. They’d just pay the claim. FedEx likely won’t pay even if he wins. I’ve dealt with both and self insured companies act like you’re trying to take their last dime.

I agree and would be upset also. However there is no way I would leave my goods with a shipper unless I had tracking numbers and a paid receipt. I do not care what shipper everyone that picked up a package from me always scanned it. I would be after the place I left it with.

FedEx tried screwing me on a claim once. Kept stalling, asking for more info. At one point they said my file disappeared and I'd have to resend everything. I filed a complaint with BBB. Had a cheque within a week. The kicker was, they wanted to know why I filed a complaint.
