can anyone identify this oil pan and what the capacity is?

Aftermarket pan. Could be made by just about anybody (Moroso, ebay, etc). Looks to be a seven quart pan (of course you wouldn't put that much in it.)

if it's a 7 qt pan....why not 7 qts plus 1 for a new filter ??
 
It is a Moroso pan! Identical to the one I have

The reason for the deep pan is to get the oil away from the crank during acceleration (drag racing). 5 quarts and maybe an extra one for the big filters is all you need and it is away from the crank. You can put as much as you want (7 plus 1) but that won't help in drag racing.
I also have the Moroso pan but mine looks different than the one pictured - in the area of the oil drain plug.
All I have ever put in mine has been 5 quarts, 6 if I replace the filter. Been doing that for over 25 years. (I'm just sayin').
