Legal advice for employee

I'm in need of advice.
Took a new role in May of '24 with the expectation of getting a Class A CDL within a year. I obtained a learners permit fall of 24. Employer gave me an online ELTD course January 28 of 25. Completed the course except paperwork in April, forwarded the documents to be completed by my boss on 4/22. Was told late June I'd have to find a 3rd party testing agent on my own as theirs has retired. Spent months trying to find one, I was also locked out of my email to obtain documents, offered to just go to CDL school and was shut down, last week I found one. Notified my boss and asked to have my ELDT paperwork completed. Monday the head guy comes in says I have till 12/1 or im fired, said he'd send me an email, but i was locked out. Somehow that day i was able to get IT finally unlock my email and log in. Finally received my paperwork today, except some are missing. Called a meeting, they said too bad you dragged your feet for months, even though i can't schedule a test without ELDT paperwork completed and verified, sent to Federal. Found out some of the blank/missing documents need to filled out by an certified instructor for BTW training, I never received or was told to find one, it was confirmed in email. So apparently now ill be fired for the first time in my life for the employer not knowing what they're doing.
So do I resign, put in a two week notice or ride it out and seek severance? I Notified them about the certified instructor and I received no response.

Seems like a long time lapse for something important.


I've seen people canned for FAR less, including me.

Me working and not letting me obtain my CDL learns permit. Was told we were to busy and we'll get to it then.
 
Honestly, I've found that any employer that's willing to fire me for trumped up reasons is not someone I'd ever be interested in working for.....ever.

Imagine how "pleasant" the work environment would be if they were forced by law to continue employing you.

When I was terminated from my management consultant deal in a final round of layoffs, I was asked to remain as a driver, with credit for accrued benefits, no severance. I politely asked to review the severance package before making a decision. It was an easy choice, and hard to keep a straight face. I'd watched other managers take the driver deal in past years. Result was like a former cop being put in a general prison population. Went to work driving for the competition the day after I signed off on the severance deal. Never regretted it.
 
You must have everything in writing to make a case. Emails are considered writing. Sounds like this is not an employer you want to work for. I’d start looking for another job.
 
I suspect there is more to the story. If I was in the same position I would question myself whether I wanted to work for a company that was dysfunctional like this one appears to be. What's the point of fighting to stay working for a company with poor management?
If you want to drive truck, go and get your license, there are tons of companies looking for drivers.
You've only wasted a little over a year with this employer. Do you want to be subjected to 20 years of the same treatment?
 
Perhaps it is best to maybe seek out another employment option, as it appears that this company that hired you isn't a very good employer at all. Just a suggestion, mind you, but that seems like the better option than to seek counsel and trial and then maybe still losing out altogether... cr8crshr/Bill :usflag::usflag::usflag:
 
I would think you are way past any solid probationary hiring period. I suspect legal advice here is best. However, if your current employer is on the ropes and motivating them pulling a fast one, there likely may not be much left to receive after a bankruptcy if you pursue legal recourse.
Seeking other employment is a slam dunk, but I would get over the emotional aspect of an unjust termination. You have not yet shared anything that you have done to weaken your position/case, and quitting is just waving the white flag, all coming from how a prospective juror would interpret the case.
 
I’d probably resign but ask for a letter of reference from them in return . Then any gaps in in employment can be explained to future better employers.
 
I think the question most important to yourself is: After all this and in feeling you were wronged, do you still want to work for these people?
 
Yeah, I'm done. I showed up this morning and told them I needed certified behind the wheel training, they told me it was false, I was then sent home an hour later, with pay to prove my claims witch I did. FMCA documents and WisDot. They then emailed back saying doesn't matter, CDL by 12/1 or fired. I work for a Village or State agency.
 
I don't want to even show up. It's like being in junior high. I just want to obtain my ELDT and test on my own and move on.
 
Dam, sorry for all your frustration. I’ve worked for a few dick companies and can tell u the grass is always greener on the other side of the road. Don’t waste another minute there. Don’t give them the satisfaction of firing you. Kim

I know, it sounds bad but I haven't been happy since I stopped working at the University, I hate the city. I contacted my former boss at the university who lives rural like I do. He's working on creating a position for me. I was too impatient and left for a supervisor position while they were arguing about creating one for me. Hopefully and unfortunately lol, I'll end up back with him, best guy I ever worked with, but he's a Ford guy.
