Error on Speeding Ticket

    I got a speeding ticket on Friday for doing 85 in a 75 on the freeway. I was leading 5 cars in the fast lane, passing 4 semis. He pulled me over because I was leading the pack. Ok, I was passing and going over the speed limit, but I’ve never had a speeding ticket in my life (just never got caught!) I looked at the ticket and found the date of the ticket is 1/21 and he said he gave me 30 days to get it taken care of. Only thing is, on the ticket he put 1/19 as the due date, when it should have read 2/19. With that discrepancy, I can’t do any online driving courses, because my due date is expired. Anyone know how to handle this? I don’t want to track down that trooper and ask him to give me a new one!!

    Take it to the courthouse and go before the magistrate. A mistake on the ticket makes the ticket null and void, although some of the information is correct, they will dismiss the ticket because some of the information is not factual. It’s happened to me many times

      I'd go down to the station and talk to the "desk sergent". I'd bet he'd cancel the ticket altogether. 10 over on a highway is the norm !!

          When you go down there to argue about the officer's mistake, make sure you forget the OK i was speeding attitude. In your head, the whole thing is a giant screwup on their part!!!..... Be willing to go to court over it, but dont act like an ass.

            Although not for moving violations, I had 2 parking tickets dismissed due to "errors" ... I'd fight based on that "technicality"... even crimes are dismissed due to "technicality"

              Getting a traffic ticket automatically dismissed because of a minor clerical error is a myth that's been around forever. If the completely wrong vehicle or license plate was on the ticket you might have a good chance of dismissal.

                That would only work for a parking ticket - in which case, why would you even bother with it if its not the correct info for your car. But with a speeding ticket you may have been driving someone else's car - the officer is ticketing "you" - not the vehicle !!

                The initial issue is getting the date changed - so be calm and sensible. If they do any extra for you - like cancel the ticket - consider that a bonus. My guess is that to change the date the ticket has to be cancelled in the system so you just might get off lucky if they're in a good mood.

                  If it were me, I'd go to the patrol station and calmly explain. They may cancel it. If not, go to court and plead not guilty and explain to the judge if he gives you the time that you'd of paid the fine if it wasn't for the wrong date. He may dismiss it, give you the fees to pay, or give you a court date to plead the case. I never get roudy with the law system.

                  I once had a young Pennsylvania State Trooper pull me over for speeding as I was returning from a Bass Tournament on Lake Erie. I was towing my boat and traveling south on 79. Didn’t pay attention to the ticket when I got it but when I got home and realized he had put the trailer plate number on the ticket. I turned it into the local magistrate and never heard another peep.

                    Actually, in a trial, the officer is alleging "you" were operating "this particular vehicle" when the offense occurred and would have to prove it.

                      I just can't believe that in that part of the country where in some places there is no speed limit someone

                      When explaining the date is wrong you should also mention that the speed is wrong too. :) Also mention that you smelled a strong odor of mary jane coming off the officer.

                        The fact he took your drivers license number and wrote it on the ticket would be all the proof he'd need. The vehicle doesn't get the ticket for a moving infraction, the driver does.

                        Arizona or Nevada patrol? Several years ago here in Phoenix the DPS put out they were not going to hand out tickets for 10 over as long as you are going with the flow of traffic. Now, if you are weaving in and out of traffic and stand out expect to see blue lights in your mirror. I’m sure that doesn’t apply to the interstate up north. As a note, they’ve been running unmarked Cameros and Mustangs along the 10 from Buckeye to the Cali border.

                        First, have you actually tried to enroll? Obviously you can't have a due date before the offense occurred. Second, if you choose the trial route, you weren't "leading the pack", you were slowing the ones behind you that were obviously speeding.

                            Or maybe ask them for a time machine so you can go back and actually meet the date posted on the ticket. Tell them you have a fast car not a time hopper.
