Unbelievable: Sold car now he want's his money back

There are some people that are just "dangerous" to be around. You don't know what they will pull, they can't be trusted and are just sketchy. I am a pretty nice guy, I'd talk to him etc. but I'd have a heck of a time giving him anything back a week later. Sold a running and driving car, now you get back a non-running car??

I hope it works out well, but I can't see that he has a leg to stand on.
 
did he sign the title as buyer? with a date? purchase price?
He just called wants to bring it back on the 3rd of Oct. When he comes in for the Hershey show., trying to work things out. He did nothing with the title. Cluster fu*k.

There is a reason he never did the Title. It was more than likely going to be sold to someone else, that way he saves $$ on paperwork. In future NEVER let a car leave like as an "open" title means you are financially responsible for that car as it is STILL in your name. I always make the buyer sign a paper stating that they own the car on this date, at this time and that they take full financial responsibility. Sadly it's not like the old days where someone's word meant something. Good luck and I hope you have agreed on a $$$ amount to take the car back.

You are being way more lenient than I ever would. Idk, maybe I'm just a bad dude.
 
I gave up my attorney's license after I retired last year, and wouldn't post advice on a public forum even if I still had it. But I would recommend you consult a local attorney prior to any deal. This situation isn't overly complicated from a legal standpoint at this stage, but it would be prudent to take a small step to keep it that way.
 
Just me (not an attorney, just played one in a movie once!), but I'd tell the buyer to stuff it.

I wouldn't lose any sleep over HIS mistake and now trying to get you to help him with HIS mistake. You did nothing wrong and should have no problem just saying "I'm sorry but the car is yours now."

10 times out of 10 the buyer asks you to sign off on a much lower sale price in order to avoid the sales tax; it gets written on the title, it does in Jersey anyway........... once the title is signed, it becomes a receipt, for the much lower price......the buyers wish to avoid the sales tax hit paints him into a corner

In PA it gets dicier - the sales amount doesn't need to be filled in until the buyer registers the car and applies for a title in his name.
 
Here in Pa. a signed by seller only title especially a un notarized one means it’s an open title and is still the financial responsibility of the person it’s titled to. That includes any damages or injuries done by this vehicle.
 
So the buyer is bringing it back now in non running condition on the 3rd ?
It was running fine at purchase. Buyer has tossed several excuses out. It's been a week or more plus the guy was fixing to jump a title in your name and your ok with this ??
 
IF...BIG IF you take the car back...nit pick it to death, say this and that were NOT like that, and low ball him. And I'd have several buddies be there too.
 
When looking at this situation. Sometimes selling a car is a problem. I remember buying 2 cars to get one. The other I had no choice it was all or nothing. Anyway short on space as I was living in town 25 years ago I had no room for it. So I put it up for sale and only had the pink slip. The Title was still being processed at the State level. Anyway guy drives from Michigan non stop only drinking a case of coke, loved the car and bought it. I have a receipt notarized and told him when I get the title I will mail it. I get the Title, call him and now he is no longer at that address and tells me hang onto it. So I do I reach out to him a few months later and he tells me he was moving in with his sister but then weeks later had a falling out and doesn't want it shipped there. HE would be in touch. Time goes by and out of the blue this Jackass who was his friend sends me a threatening e-mail that I have screwed his buddy around long enough and he put a lot of time into this car and STILL doesn't have the title. He will be getting a lawyer and police involved if he doesn't have it in a week. I send a message back saying he was the one who literally had NO ADDRESS to send it to. Got an address and sent it certified mail. Never heard from his buddy and I for some reason never forgot that ********'s e-mail address... I found it funny him being homeless was MY FAULT maybe he should not be buying a car but instead a place to live! I hope this goes well for the seller.
 
Sold my 64 Savoy Monday, came from Ohio with a friend to look it over.
Had it up un the lift so they could look it over good.
They looked at it for nearly an hour.
Made the deal Cash and I drove it onto his trailer.
Yesterday he calls and said I want to return the car. WTF.
He said he thinks I made a 2 door out of a 4 door.
I told him the vin will tell you it is a 2 door.
Said he did not believe me and wants to bring it back and get his money Baack.
And he could not get it started and had to push it off the trailer. I started it several times and drove it up on to his trailer.
NOW WHAT TO DO? Buyers remorse.

In my earlier post mentioned a bad experience my dad had selling his car to a guy who lived in the hood, felt sorry for this guy, giving him a nicer deal on the car. Signed the title and gave it to him. MISTAKE. Month later the city PD called and informed of numerous parking tickets due and was to be impounded. The BS began about my dad being the owner on record of the car yet.

Works both ways. Buddy bought a car trailer last year from a biz that sold them among other stuff. Owner said he’d locate the title and promised to send it. Five MONTHS until he finally got the title so he couldn’t plate or use it risking being snagged using it. Biz owner was selling out and he had done repairs on the trailer for the owner who didn’t pay up. At least he got the title; but could have been worse.

Just can’t risk trusting anyone – those days are sadly over..
 
I guess I can share my bill of sale lesson. I was 19 years old and had a 66 VW baja bug that I drove off road way more than on. I got woke up (with a hangover) one Saturday morning by a knock on the door of my apartment. My bug was parked outside and this guy saw it and decided he had to have it. It wasn't for sale, but I was tired of keeping it going and made a deal to sell it for $285, minus the centerline wheels and tires. The guy gave me the cash and I held the title until the guy put his wheels on and returned my wheels and tires. No bill of sale was written at that time, just a handshake and a promise, and the guy drove away in the bug. He didn't return right away like I expected, then maybe a month later I got a letter from the state talking about my financial responsibility in a fatal accident. It took some sleuthing to discover that the guy got in a head on collision with a 4-wheel drive truck, in the wrong lane, at a combined speed of 105 mph, about a mile away from my apartment and killed himself, almost killed his passenger, and messed up the 2 folks in the truck. I wrote a letter explaining the circumstances (minus the hangover) and sent it off. I never heard back from the state again and I surmised that the guy's parents (or someone) corroborated my story to their satisfaction. I have never sold another vehicle without a signed bill of sale since.

I also went to see the bug in the wrecking yard a block away from that apartment and was appalled at the damage and the carnage inside the vehicle. I've never owned another bug since.

A quick story:

In 1988, I sold a '64 Chevy C-10 stepside to a guy in the city. Cash deal, I had the title notarized (required in OK) and he got the truck. I made two copies of the BOS and kept one for me. Back then, the tag stayed with the vehicle and not the person.

Two months later, I get a visit from Johnny Law. "Do you own a 1964 Chevy pickup, stepside, blue?"
"I used to, why?"
"Where were you on such-and-such day?"
"I used to own the truck, sold it two months ago, so where I was doesn't matter. So, why are you asking?"
"A blue Chevy truck, registered to you was involved in a robbery and shooting at XYZ, you know anything about that?"
"
Once again, the pickup is NOT mine any longer. Obviously the buyer hasn't transferred the title. I will happily show you the copy of the BOS, which has his address on it."

I went inside and got the copy, which I made a copy for Johnny Law. He looked at it, I pointed out the VIN and the buyer's name and address. He wanted both copies, to which I said "oh, ****, no!" I gave him his copy, said "there's all the information, there is his address, go get him!", and closed the door. Never heard another word about it again.
