It's been 4 months now and I can't get the body shop to get me an update

Officially 5 months now and I sent them letter stating an ultimatum either get the car done by the 2nd week of march or give it back, if work has been done we will settle up with a proper invoice checked by the state for accuracy and you can pull the money owed from the deposit.

State agency dealing with auto body shops has been called and will be paying them a visit soon.

I sent this letter certified mail, after my lawyer said it could be used if worded right as your own estimate since he didn't write me one, spelling out the work to be done the agreed upon amount and a deadline date. I also gave them 10 calendar days to respond and the ultimatum was 3 fold like stated above finish car by date, give it back untouched or if touched settle up and be done all his choice.

It took 7 days just to get to them via the usps not sure why but I started the clock once I saw the it had been signed for and delivered.

6 days later he called me, and finally admitted he hadn't touched the car but did so in such a BS lieing way it was kinda funny, it begins to tell me he had been giving me verbal updates on another road runner he is doing a frame off, and that oh yeah your car has not been touched blah blah, then asked me when I needed it I said by the 2nd week of march like the letter says, he fumbled around with more bullshit and lies blah blah, and started telling me how he had hired a moving company to move his spary booth tomorrow blah blah and I said oh wait you told me you were extending you stay until the end of April? - silence then more bs about his shop floors got done sooner than he thought blah blah.

So I called my credit card company and they are all over it, no limit to disputes and send us all your docs we will immediately refund the money to your account and begin tying to contact the business and in 15 days they do not respond we automatically rule in your favor and it's done, if they do respond we make them send us the signed estimates between the two of you showing what work has been done and since we know he has no actual estimates signed by you we will slap his *** and refund your money sending the amount to collections.

Next, the last part of the conversation is a part I'm sure you guys will give me **** for, but **** it, so I told him look I want my car done and don't want to have to start over somewhere else, what do you think you could get it done now knowing you are moving your whole shop to a different city by the end of this month? he said let me look at my calendar, and came back and said well 2nd week of may I can deliver your car done, I said ok great I'll agree to that on one condition you put it in the form of an estimate with the delivery date shown and I will sign off on it and wait until May to get my car back. he said ok great I'll send it over tonight! cool I said Ill be waiting. this was all after 5 pm by the way.

Next day no estimate, and no surprise either, thought to myself let's be fair as a business owner myself dealing with people after listed business hours and telling them I will send a document to them would be an automatic next business day thing, so I gave him until the close of business the next day to send the estimate over and again no surprise he didn't send it.

All this time I have been communicating with my state investigator and keeping updated on what's been happening, and keeping him in the wings until after this letter was received, now I released him to go find out where my car is by demanding and address and also citing this shop for not giving me an written estimate and also subbing the work out on my car or he was trying to, both offense that he will get fined for.

He is also getting the guys new shop address as well.

Back when I was trying to get him to give up the location of where my car was being kept, I Asked him to take pictures of certain suspension parts as a way of seeing if I could get recent pics of my car so I would at least know he still had access to it or know where it was, here are some of the pics he sent. What really set me off was the RUST has set in on the disks and MC and other parts which mean my poor car which had been garaged since I owned it has been sitting out in the rain all winter!!! **** me I just spent an entire summer cleaning and rustproofing the underside go dam it!! and the MC was brand new! On top of that I had taken some of the paint off myself around the front and rear windows so I could see just how bad it was and also on the quarter panel at the passenger's door so in some spots it was down to bare metal when he took the car last SEPT.!!!

Notice on the suspension pics he is real carefull not to get any of the body in there?? ******* prick knew he hadn't touched my car yet and straight up lied, then tried to cover that lie with another lie to admit he hadn't touched my car what a **** face.

Bottom line is I am trying to get my car back, short of being escorted with cops to his shop just to be told he does not have possession of my car but finally tells me where it is who knows how this is going to play out now but by god dam I will get my car back one way or another very soon.

Now what? get the car back home and strip it myself? by hand or get a media tank from HF and make a mess in my driveway or get a dustless mobil guy to come out or take it to a place that wanted t o use sand and told me my whole interior would get sand in it..wtf?? thinking I am going to tackle it myself unless the dustless guy is reasonable. Ok so car is tripped of paint and filler and there are 1" by 1/2" holes around the rear window, maybe one at the front, weld those up? I only have a 90 amp wire welder will that work? I have been practicing, re doing my stock sway bar brackets got new straps coming from a dude re-poping them in Florida $44 not bad just weld on slip in bushing and tack other side grind to clean and done. what do I do? finding a decent paint guy near me another major challenge, man this sux I'm electrician and don't claim to know the first thing about carpentry that's why I hire woodys or plumbers etc and they hire me, tackling this may be too much for me, fixing welds maybe not so bad, body work getting it straight flat whatever doors aligned?? man tough one. need help guys

That's actually a fairly common crack in these hard tops, shows the body flex. Weld it up.

Dude I would love nothing more but it is not at his shop and he won't say where it is being held, I have been trying six ways to sunday to get him to spill it but he is a master at this game I am not so **** me, waiting until the state gets done with him and will see if they get an address I will go there the next day and get it no worries there. I will say this his whole scam is pretty good, sucker you into taking on your project for your budget getting you to commit to a deposit using that to pay other bills while sitting on your car for months/ years giving you one excuse after another. What sux is I got star struck by the bullshit bling and just wanted a decent paint job for under $10k I have never had to deal with a body shop before only insurance crap, so even though I went into this thinking I was going to use the instructions I read here about doing it piece by piece, then get paid then do a piece then get paid etc to incentivize them into getting it done on time, it just didn't' dawn on me that by giving him a deposit to start I would have no control from that point forward! what a ******* mess man just more delays on getting a decent paint job this world sux balls man people are fucked.
 
I'd say it's past time to get the cops involved...he's holding your car hostage.and there ain't no way I'd want this asshole to touch my car.
 
If I didn't know better, I'd swear you are describing SHELLY"S AUTO BODY in Danielsville, Pa. Scum sucking liar of a Chevy guy pulled similar crap in 1988. Hostage, lies, and a **** job in the end. I say take it out of there.

Every time I approach the car and see the scratches that asshole put in the rear window it rips me. When taking the window out, he slid it on a shelf - face down - and lacerated it but good. Shelly's. Hope he rots. The shop is on Mountain Road under some high-tension wires. I hope they don't cause him any long term health problems. Just sayin.
 
Once you get your car back how about naming this shop/guy, I'd hate to read in a few months that another Mopar owner is dealing with this crap.

Anyhow, it might be time to get the law involved if he won't produce your car.

I have spoken with both types of people leaving reviews good and bad,

the guy with the 69 maro said he had to keep calling this shop to get in order to get progress done and like me was promised a 3 month turn around but turned into an 8 month one, and now has his car back and as you can see on his yelp review is happy wih the end result but he just told me that this shop promised to buff out his car after a few weeks and they wont return his call now he is pissed.

be sure to scroll to the bottom and find the hidden reviews, I missed them when I checked I guess this shop has negative reviews removed. there are multiple from the same guy near me he burned out of 15k and his GTO has to be completely re stripped and started over so even If I would have let him finish there was a good chance it would have been **** anyway.

Just got word the state has released the hounds and I should know where my car is at by this evening preparing to go get a trailer if needed to get my car tonight or tomorrow morning first thing update you if it happens. If they don't get The information then I file police reports in different counties and cities reported stolen also call my insurance
 
YEP, get a trailer and get it out now. If its not at the shop, find it and start over.
 
Glad to know that this guy will not be touching the car. Imagine the mess he would make of it. Just hoping now that it actually does make it back to you.
 
Man that sucks! Hope its back home soon. I don't get that the car isn't on his property and won`t tell you where it is. I would automatically be reporting it stolen. Looks like you have the ball rolling though. I don`t think I would be giving him anymore chances to make it right. Good luck!
 
Been a few days since the Big man JB has updated us, kind of thinking that retrieving his Roadrunner is like finding a needle in a haystack. Hopefully good news comes soon.
 
So here is the update,

I finally got an detailed estimate, with a start date and a delivery date. It also now shows and explains shop rates for the overall job and rates for any unforeseen metal work etc. I even got them to show they will be delivering the car to me, and part of this deal was I would reassemble the parts taken off like bumpers lights etc. They even explain the levels of orange peel what how much more it will costs to make it perfect ($750 by the way) It only took 5 months and a bunch of supposed miscommunication / misunderstanding. I just hope that is all over!

Right now I am going to proceed, based on the state's backing in this situation I feel I have a big brother in my back pocket now. They have given me more confidence all the while explaining the risks and consequences as well as my rights and what they can do to help me get my money's worth.

Its not over yet, he still has to do the work and it has to be decent, for a under $10k paint and body work for a show quality job I will be inspecting it closely at least to the things I know about. Its hard for me because we painted the engine bay 3 years ago, and I Know I have scratched it up already and wonder just how well this new paint will match or blend with the old. I have to keep reminding myself not to get too excited and to remember I only wanted it to shine and not have any dings or dents.

I also have to keep reminding myself there will be things not perfect and it was what I originally expected. So I have to not get pissed off or go nuclear if its not 100% perfect.

I do feel taking my car and my money knowing dam well they we not going to start the work right away is completely ******* unacceptable and I am pissed about that. however I did at least prepare myself in the beginning for a 6 moth duration. in the end it will be 8 if it comes true like the estimate says. But one thing is for sure the next project will be done to a point by myself up to paint and when a shop says its ready to take it I will be at their door everyday, lol

Hopefully the next pics are progress ones and then mid May done ones. fingers crossed!

WOW after all you have gone through you still left your car with him. I hope it all turns out ok for you. Nice car by the way, it looks like it deserves a nice paint job. By the way I have painted 2 cars in my life and didn't get any orange peel. One I did out in the back yard jet black. Good luck to you my mopar brother.
